Welcome to Smolly ("the App"), a pet wellness companion developed by Smolly ("we", "us", "our"). By downloading, accessing, or using the App, you agree to these Terms of Use.

1. Acceptance of Terms

By using Smolly, you confirm that you are at least 13 years old and agree to be bound by these terms. If you do not agree, please do not use the App.

2. Description of Service

Smolly is a mobile application that helps pet owners track their pets' health, nutrition, and wellness. Features include:

• Pet profile management
• AI-powered health chat assistant
• Food and calorie tracking with nutrition scanning
• Health record keeping and vaccination tracking
• AI-generated pet portraits
• Calendar and health reminders

3. Not Veterinary Advice

Smolly is for informational purposes only and is not a substitute for professional veterinary care. The AI assistant provides general pet wellness guidance based on publicly available information. Always consult a licensed veterinarian for medical decisions regarding your pet's health.

4. Subscriptions & Payments

Smolly offers a free tier with limited features and a premium subscription ("Smolly Premium") with enhanced capabilities.

• Billing: Subscriptions are billed through Apple App Store or Google Play Store. Prices are displayed before purchase.
• Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
• Cancellation: You can cancel your subscription at any time through your device's subscription settings (App Store or Google Play). Cancellation takes effect at the end of the current billing period.
• Refunds: Refund requests are handled by Apple or Google according to their respective refund policies.
• Free Trial: If offered, the free trial converts to a paid subscription unless cancelled before the trial ends.

5. User Content & Data

• You retain ownership of all content you create in the App (pet profiles, photos, health records).
• You grant us a limited license to process your data solely for providing the App's services.
• AI-generated portraits are created for your personal use.
• You are responsible for the accuracy of data you enter.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse-engineer, decompile, or hack the App
• Upload harmful, offensive, or inappropriate content
• Share your account credentials with others
• Use automated systems to access or interact with the App

7. Intellectual Property

The App, including its design, code, branding, and content (excluding user-generated content), is owned by Smolly and protected by intellectual property laws.

8. Limitation of Liability

To the maximum extent permitted by law, Smolly shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App. Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

9. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free service, and AI responses may occasionally be inaccurate.

10. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated terms. We will notify users of material changes through the App.

11. Termination

We reserve the right to suspend or terminate your access if you violate these terms. You may stop using the App at any time.

These terms are governed by the laws of the jurisdiction in which Smolly operates, without regard to conflict of law provisions.
